SPIRIT HUNTER COMPETITION
TERMS AND CONDITIONS
1. Entry into this competition is deemed acceptance of these Terms and Conditions.
2. The promoter is the Yoorana Gunya Family Violence Healing Centre, operating as the Binaal Billa Family Violence Prevention Legal Service, of 18 Spring Street, Forbes NSW 2871 (Promoter).
3. Entry to the competition is free and open to all permanent residents of Australia, except:
(a) employees (and their immediate families) of the Promoter; and
(b) agencies associated with this competition.
(entrants).
4. To enter, an entrant must:
(a) complete an entry form; and
(b) submit his or her entry in accordance with the Entry Guidelines.
5. An entry may take a variety of forms. The entrant is encouraged to utilise the Spirit Hunting Tools as a guide. However, the Spirit Hunting Tools are not restrictive of the types of entries an entrant can lodge.
6. An entrant less than 18 years of age must provide the Promoter with the consent of his or her parent or guardian before entering.
7. The Promoter reserves the right, at any time, to verify the validity of an entry or to verify an entrant (including an entrant’s identity, age and place of residence) and to disqualify any entrant who:
(a) submits an entry that is not in accordance with these Terms and Conditions; or
(b) tampers with the entry process; or
(c) is not eligible to participate as an entrant.
Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
8. Entry forms must be received by the Promoter by 5pm AEST on 10 December 2009. No entries will be accepted after this date.
9. Each entrant can only enter ONE award category, not multiple award categories. The award categories are listed on the entry form.
10. Within each award category, an entrant may submit multiple entries by completing a new entry form for each new entry.
11. Entrants who choose to enter via a Spirit Hunter video station are still required to submit an entry form.
12. The judges will select ONE winner from each of the five award categories. Each winner will be awarded a prize or prizes to the value of $1,000. The prizes may include educational resources, laptop, MP3 player, digital camera, barbeque, art supplies and sporting equipment. The Promoter reserves the right to change the prizes at any time. The winner will get the opportunity to nominate which prize or prizes to the value of $1,000 it would like to receive, however, the Promoter takes no responsibility for the winner not receiving a prize or prizes of its choice. Prizes, or any unused portion of any prize, are not transferable or exchangeable to any other person or in respect of any other prizes, and cannot be taken as or redeemed for cash. The Promoter is under no obligation to honour any prize which an entrant has transferred or sold.
13. The judging will take place some time after 5pm AEST on 23 February 2010. The Promoter’s decision is final and no correspondence will be entered into regarding the result.
14. All winners will be notified by telephone, post or email using the telephone number or address given by the entrant on the entry form. The Promoter will not advise entrants of failure to win a prize. The Promoter is not responsible for contacting winners by any other method or for winners not receiving notification (including as a result of a change to, or incorrect supply of, an email address, telephone number or postal address).
15. The Promoter reserves the right to publish the winner in each award category on the Promoter's website.
16. The Promoter will provide prizes to winners at the awards night on 5 March 2010. The Promoter reserves the right to change the date of the awards night and will notify the winners of any such change.
17. In the event that a winner is not able to attend the prize night, the winner must claim his or her prize or prizes within four weeks of being notified by the Promoter. If any prize remains unclaimed at this date, the Promoter reserves the right to, at its absolute discretion, award the prize to another entrant within the same award category. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize of similar value or specification.
18. The total prize pool value is $5,000 worth of prizes. Prizes can not be transferred to any other person.
19. The Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
(a) to disqualify any entrant that breaches these Terms and Conditions or interferes with the competition; and
(b) to modify, suspend, terminate or cancel the competition, as appropriate.
20. Any cost associated with accessing the Promoter's website is the entrant’s responsibility and is dependent on the Internet service provider used.
21. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury, illness or death or any loss or damage (including loss of opportunity) whether direct, indirect or consequential, arising in any way out of the competition or any prize, including, where arising out of the following:
(a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
(b) any theft, unauthorised access or third party interference;
(c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
(d) any variation in prize value to that stated in these Terms and Conditions;
(e) any tax liability incurred by a winner or entrant; or
(f) any use of a prize.
22. The Promoter collects personal information in order to conduct the competition and may, for this purpose, disclose such information to third parties. Entry is conditional on the entrant providing the relevant personal information. Entrants should direct any request to access, update or correct any personal information to the Promoter.
23. All entry forms and entries become the property of the Promoter on receipt.
24. The entrant consents to the Promoter using the entrant's name, likeness, voice, image or other information concerning the entrant and its entry in any media for an unlimited period without remuneration for the purpose of promoting the competition (including any outcome).
25. The entrant releases the Promoter and its related parties and agents from any and all claims and causes of action whatsoever (including, without limitation, any infringement or violation of personal and/or property rights of any sort (including defamation)) arising from the production, promotion, distribution and exploitation of the entrant's personal information) or any exercise of the rights granted to the Promoter and its related parties and agents in these Terms and Conditions.
26. The entrant waives any rights it has to take any action against the Promoter for an infringement of any past, existing or future Moral Rights (as defined in the Copyright Act 1968 (Cth)) in any materials that the entrant provides as part of the competition. The entrant consents to the Promoter reproducing any material submitted by the entrant in the competition.
27. The entrant assigns any present and future copyright in any materials it contributes to the competition and any other rights which the entrant may have in the material it submits as part of the competition to the Promoter.
28. The Promoter is not obliged to use, keep or exploit the entrant's material. The Promoter may do or omit to do any and all acts in relation to any and all of the entrant's material, including altering, adapting, rearranging or editing the materials as well as promoting, marketing, distributing and otherwise exploiting them in any media, entirely at its sole discretion.
29. The entrant warrants that it:
(a) owns all copyright in any materials that it assigns to the Promoter in these Terms and Conditions;
(b) the use of its materials or contribution to the materials will not infringe any rights of any third party; and
(c) has obtained all necessary approvals and consents in connection with each entry.
30. These Terms and Conditions will be construed according to the laws of New South Wales and references to times are references to the time in Sydney, New South Wales. The word ‘including’ is not a term of limitation.
